Yes it was not an empty threat. I received the papers on Saturday, June 7th, 2008. At this time I have no comments about the case. I will need support to fight this case just about from everyone who cares and had been following this issue.
Greg Swann, after defending me on his blog and bringing the attention of real estate agents nationwide to this issue , has created the defense fund to help me in fight this case. I have no words to describe my gratitude to him or to anyone who offered their support so far.
Bellow are the papers in connection to the lawsuit. The suit was filed on June 4, 2008 at the Superior Court of Alameda County:

Thank you again to every one. I have never been sued before in my life, I am presuming it is natural to feel sick to my stomach. I only imagine what that would be like without your support.

The quick way to prevent robots visiting your site is put these two lines into the /robots.txt file on your server
I would estimate they did this around October/November and didnt change it.
Now ejerks go fire your webmaster and stop the stupid lawsuit its your webmasters fault not anyone elses.
