Eperks And Vlad Zablotskyy Settle The Lawsuit

Dear Readers:

To the extent that any of my prior posts and comments may have implied that someone at ePERKS was responsible for the publication of a false and defamatory story about my personal life, I must state that my statements were not based on forensically verified evidence, as anyone may have committed those acts. Therefore the public should completely disregard those messages, in particular comments about ePERKS management.

The lawsuit between myself and ePERKS has been resolved to the satisfaction of all concerned. It would be most appreciated if those that have written about or posted articles regarding this topic would please remove such statements and/or post a letter of retraction regarding the matter. The ordeal has brought about much harm for both sides and it is the party’s intent to put this matter to rest and move on.

Regarding the subject of free speech, ePERKS has expressed to me that it is a strong advocate of free speech and it was never its intent or desire to impede on healthy debate and feedback from the public. Until I have reason to believe differently, I have decided to take ePERKS word on this. In the past, the parties had differences of opinion about the source and content of many ePERKS related posts on go-beyond-MLS.com. We have likewise reached agreement on how those disagreements will be dealt with moving forward. I have expressed to ePERKS in the past that I believe that its model is a great idea. I have received assurance from ePERKS that its management will take legitimate feedback to grow the model productively and continue forward. Both parties wish the other well.

  1. I'm glad it's over for you, Vlad, and I hope that you'll suffer no further expense. I'm confident you would have prevailed on your motion to dismiss for lack of personal jurisdiction, as given here: http://apps.alameda.courts.ca.gov/domainweb/htm
    (Select the Case Summary link, then enter case number VG08390958.) Interesting that behrouzi decided to settle before spending money on opposing your motion. Anyway, it's clear that your message above was negotiated and written by lawyers, and that you're just posting it here as a condition of the settlement, to make this thing go away. I don't really expect those who have commented about the lawsuit will delete their commentary, or post retractions.

    These sort of things are generally written by the lawyers on both sides.
    Unfortunately I am not free to discuss the terms of settlement. I did learn
    many lessons from it, and now am looking forward to put this behind me.
