Many real estate agents familiar with Reply.com, might find the bellow piece of information rather interesting. The information is posted on BBB.org website on Reply.com profile. I will however put it here in it’s entirety. I don’t believe that $70,000 in fines will put a dent into Reply.com’s finances. After all Reply.com did file for IPO and once Reply.com’s stock starts trading there will be rivers of milk and honey flowing in San Ramon and surroundings…. Or something to that effect, unless the “IPO spoof” was really a “for sale” sign.

Enough said, here is what apparently took place in the beginning of this year:

On January 21, 2011 the Contra Costa District Attorney’s Office entered into a Final Judgment and Permanent Injunction with Reply! Inc., Case no.: C11-00208.
Without any admission of wrong doing the injunction applies to Reply! Inc., its agents, employees, officers, managers, representatives, successors, and assigns when acting on behalf of defendant.
Reply! Inc. is hereby permanently enjoined and restrained from directly or indirectly doing the following during telephone solicitations of real estate agents for the sale of real estate leads (Leads).
a. Representing that use of Leads may result in an average or anticipated close rate, unless Defendant is able to produce data based on the experience of customers who have purchased Leads from Defendant supporting any such representation.
b. Representing that Defendant’s lead service can be cancelled at any time unless defendant also discloses: that written notice of cancellation is required; the period of time that will elapse before the cancellation is effective; and that, until the effective date of the cancellation, the real estate agent will continue to receive leads and be billed for such leads.
c. Representing that real estate agent will not be charged for invalid Leads or will receive a credit for invalid leads, unless Defendant also discloses the time limit within the request for credit must be received;
d. Representing that credit will be given for invalid Leads, unless Defendant also discloses that no credit will be given as long as the name and telephone number provided with the Lead are valid, even if the Lead does not respond to the real estate agent or does not want to be contact.
e. Representing that Leads are “valid”, “validated”, “good”, “screened”, “qualified”, “verified”, or words to that effect, unless Defendant discloses: (1) the validation, screening, qualification, verification or other such process is automated and as a result some Leads will have invalid names or telephone numbers, (2) even for such invalid Leads, the real estate agent must make a request for credit within the time limit for such request and in accordance with company policy, (3) Leads are not screened for credit worthiness; and (4) some Leads may not respond to the real estate agent or want to buy or sell real estate.
f. Representing that any Lead will actually be interested in buying or selling real estate, unless defendant also discloses that Leads are generated through Defendant’s websites and affiliated websites, and consist of people who are looking online for real estate information.
g. Representing that any leads consist of people who are seeking a realtor or expect to or who expect to be contacted by a realtor, unless Defendant also discloses that: a Lead is created when a consumer completes and submits a form on the Internet requesting real estate information; including home valuations, and provides a phone number at which they can be reached; and (2) Defendant does not guarantee that the consumer will actually be interested in buying or selling real estate or that the agent will make contact with the Lead.
h. Representing that the real estate agent may accept or reject Leads.
Reply! Inc. shall pay civil penalties in the amount of $40,000.00 and investigative cost related to this matter in the amount of $30,000.

A minor point of irritation, for me, was to discover just how badly blogger.com treats things like meta tags.

Now I know full well that meta tags are not exactly ground breaking for SEO but when it comes to social linking several tags can be quite important. Specifically the meta description tag. When posting a link in facebook the meta description is the first source of content for describing the link.

I first noticed this when working on my Face Link tool which was created to make facebook link links for blogs. Here is an example of a good looking link to my blog. You can see that the tool was able to get a title and a description

Beyond making my little applications work the meta part of a web page also impacts of the quality of your search engine results listing. The description being used most often as the text that goes with the search result.

As such in a competitive market not using a description tag is a fatal mistake that your competitors will take advantage of.

So the result is not just that pretty much all blogger blogs produce rubbish looking links in facebook but that they have a significant disadvantage when the going gets tough. After searching for a while I have concluded that there is not really a decent solution to this aside from putting Google off with duplicate description and keywords.

In short blogger.com is not, in my opinion, suited to the world of web 2.0 nor business marketing.Similar Posts:

Many internet startups find it privileged to be reviewed by TechCrunch. But even if TechCrunch’s verdict for you is a deadpool, although the author did not tagged that post with “deadpool“, it is still an opportunity for dialog. LeapFish’s employees screwed up so badly that opportunity that TechChrunch team had to ban their IPs from posting comments. Here are the snapshots of some parts of that exchange:

Later the CEO of LeapFish showed up and “apologized” for his employees- you can read the entire exchange on TechCrunch.

Back in May, United Kingdom legislators have made it illegal for businesses to engage in the above described deceptive marketing.

It may not be such a bad idea to prohibit and criminalize such behavior here in the US as well. Don’t you think?

I have been member of MyBlogLog since December of 2006 (feel free to add me to your contacts). You probably recognize the widget that shows the latest visitors to this blog located in the side bar.

Through this widget I have met and connected with many outstanding bloggers, business owners, real estate agents and just your regular every day Joe and Jane. In fact it is one of the first place I check every time I work on my blog. Just to see if there was some one new today on my blog or to be absolutely humbled by the fact that some one found my blog interested enough to pay another visit. Never have I imagined I will be banning some one from appearing on that widgets. In fact I never new exactly how to do it. So I learned today…

To my surprise it was very easy. Just hover with your cursor (aka mouse) over the picture of the person you would like to ban. A small red square with a white “X” (as shown in the snapshot below) will appear in the upper left corner of the persons avatar- you have to click on the red little square:

You will be taken to a confirmation page on MyBlogLog website. On that page (see another snapshot below- click on it to see the full size) you have to click the button that says confirm:

That’s it now you know how to ban some one’s avatar or picture appearing on your website. You might have to repeat the above steps if you have several blog listed on MyBlogLog and each blog having its own widget- although I am not 100% sure.Similar Posts:

Renaming My Blog. Can You Help Me?

I have decided to make a major change on this blog. As you can see I am going about it in an usual manner, but I would also like the regular readers to help me out.

A little background….

I owned this domain from the time I have been active real estate agent. The headline “Real Estate Review Blog” sounded like a good idea at the time. However it does not reflect accurately what this blog is all about. There are plenty of outstanding real estate bloggers who at the same time are also great Realtors. I think it is not my place to even address this aspect on my blog, since I do not have hands on experience in the real estate industry.

It is also reflected in that 90% of what I have written here are only remotely related to real estate as my targeted audience is real estate agents.

The traffic to this website and keywords by which users find my blog speak laud and clear. Many of visitors have come to look for subject related to blogging, internet marketing and social media marketing. I am not sure I have ever planed for this, but I think I am ready to start making lemonade out of free lemons.

I have an idea as to what the new headline will read, however I would like to hear your suggestions.

RSSPieces: Will Their Pieces Stick Together Without Mary McKnight

Trying to bring myself up to speed with things around real estate blogosphere I have came across across the RSSPieces announcement that Mary McNight, the founder and (now former) Chief Marketing Officer of RSSPieces “is no longer part of the day to day operations of RSS Pieces”.

During last week I have e-mailed Mary once or twice and never received a reply. Very unusual of her, since in the past Mary would respond to my e-mails rather promptly- at times within minutes.

On her Active Rain blog Mary wrote briefly that her relationship with RSSPieces went south. Evidently many of the Mary’s social medial accounts where hijacked, but she is on they way to recover them.

So will the pieces at RSSPieces stick together now that Mary is gone? From the comments on RSSPieces appears that they might already be falling apart.

I personally never was Mary’s client and our paths would not have crossed if I was not interested in Internet Marketing and Blogging. Needless to say Mary has my respect and support. Mary had build a strong and respectable profile for RSSPieces. She is well known and respected in various circles of this wonderful new media we call blogging. It is hard to know what really happened and what Mary is planing for the future. Real Estate Radio USA is interviewing Mary today, so I am looking forward to that interview.

I am certain though that Mary will have no problem to be successful no matter which direction she decides to take. RSSPieces on the other hand will have to struggle and really step up a bit, especially now that many of the clients are disappointed and confused.Similar Posts:

I the recent weeks I have been recipient of generosity of many people (most of them I have never met in my life). I am in particular thankful to real estate bloggers for their generous contributions to my defense fund.

I am not sure how I missed that Charles Richey has been diagnosed with Guillain-Barre Syndrome but I will be heading to donate to the fund as soon as this article is finished and goes live. I hope you can do the same.

Do You Use Twitter? Then You Will Love TwitterFeed!

If you do not know what Twitter is, I have published a video called Twitter in Plain English just few days ago. If you are going to watch the video now, replace every “family” and “friends” with “business” and “clients”. I guarantee that you will think of at least one way you can use Twitter by the time video is over.

On of the way I use Twitter very often is to let every one know that I have written something on my blog. In order to do that in the past, I had to login to Twitter and and make an update with the url to my latest post. Here where the Twitter Feed comes in. Every time you update your blog with a new post, Twitter Feed notifies your followers automatically.

The set up for the Twitter Feed is simple and once set you can literally forget it. If you write blog posts frequently I recommend to set your blogs feed to be checked several times a day. Twitter Feed is checking this blog’s feed every 6 hours, which actually is a little too often since I do not post here every day. I hope you find this tool as useful as I do. Fizber website just got bigger by about… 15,000 pages. Can you imagine? Well this time around it seams like they are trying to provide some useful data about neighborhood safety. Announcing the launch of crime and safety resource on their website today, Fizber’s VP of Marketing Julia Foster was quoted in a press release:

Crime rates are based on local crime statistics from the FBI and the U.S. Justice Department. We reveal the safety from crime for every community in America, and show you how each community compares to other communities nationwide, so you can make good decisions for you and your family.

Not so long ago I posted a video, in which founding CEO of PropertyMaps defended their decision to publish neighborhood data on sex offenders. Fizber’s safety information does not include that information.

Short Sales Website Launched

A new website called 96short.com was launched today. The website is aimed at providing assistance to overextended homeowners in Virginia, Maryland and Washington DC. If you live in one of these areas and have fallen behind on your mortgage payment and are facing a foreclosure make sure to visit the website.

Matt Marting the confounder of 96short.com explains in today’s press release:

A short sale means selling your home for less than what is owed on the mortgage. Short sales can be a good deal for many borrowers – those with piggy-back mortgages, mortgages that exceed the current market value of the property and other overextended homeowners – provided the lender agrees to accept the proceeds of these short sales as payment in full

Matt Maritn, who is also the president of Matt Martin Real Estate, claims that his short sale team has closed on 10,000 of such transactions in the past fourteen years, effectively saving about $1,000,000,000 to customers.

Martin also quoted a real life example of how the short sale can help individual homeowners:

We met a great couple who had purchased a home in Bristow, VA, $630,000 at the height of the market in late 2004.They had taken a Pay Option or Negative Amortizing loan for the property and, when they contacted us, they owed close to $700,000 because of the negative amortization. The biggest problem was that the property was only worth $550,000 and, after fees and commissions, they would only be left with around $510,000 to pay towards the mortgage. We negotiated a short sale with the lender to write off the $190,000. The lender only asked for $5,000 in return for the write-down. The couple was then able to buy a new home in the same neighborhood for $200,000 less than what they were stuck with in their old home.

Realty Lifeline- agent-to-agent free referral network was announced today at PRWeb. Website is aimed at providing real estate agents to share the referrals. Any agent can submit and bid on referrals for free. However every referral will expire in 90 days. When submitting a bid no personally identifiable info of your seller or buyer is required. After another agent successfully accepts the bid, you finalize your bid with that agent:

What are Bids?
When a referring agent posts a Rerrral on our site, it is available for all other agents to view. If you would like to get that lead (or Referral), you must place a “Bid” on it. When you place a Bid on a Referral, the referring agent can review your profile and reviews from past Realty Lifeline transactions.
How do I bid on Referrals?
You create a Bid by clicking on the Bid on this Referral button on the Referral Details page. The referring agent will review all of the Bids that he or she gets, then choose an agent that they want to work with. Who is selected is entirely dependent on the referring agent.
What are Active Bids?
A Bid is active on a Referral unless you withdraw it, or unless the Referral expires.
I’ve submitted my Bid… what’s next?
The Referring Agent will review Bids as they come in and make a decision on will get the Referral. When a Referral is awarded to you, you will see a message on the Home page and the Referral will appear under the Pending Transactions section.

Yea, right!!! – If that was your first reaction when you saw the headline for this article, do not worry you are not the first one. In fact when I recommended Hittail as must to have tool for every real estate website, I have received somewhat similar reaction by some one from SEO Web Design:

Erm… still requires money? The features work exactly the same as Google Analytics and Webmasters Tools. However, i think Google is far better because it allows us to set goals to track our landing page conversions, shows the query terms that your website appears in, search terms that get you visitors and much more. It is free and has no limits on the number of visitors. Isn’t it better? I don’t know, it is up to our friends here and i am just sharing. Cheerz

I am not going to argue that Hittail is better that Google analytics. However, it was Hittail and not Google who brought me through their “suggestions” to a point when I can say without slightest exaggeration that with Hittail I am better off by about $1,725 each month.

As they say pictures are worth more than words, so I have taken some snapshots from my Hittail Account to demonstrate to you how much Hittail really helped me. The images below are the snapshots from the “Keywords” tab. If you are using Hittail you can find that info just above the list of keywords under the “Keywords” tab. That info changes from day to day depending on the search hits to your website. As you will see from the snapshots below I am currently tracking 5 websites with Hittail. All of them are listed under the “free account”. All of the websites below, had virtually no natural traffic from the search engines wen I started to use Hittail.

It is true, the figures in the above images are calculated on $0.50 per click basis. It is also true that if you optimize your lading pages well you can maintain $0.10 per click. However there are niches, including real estate, where even well optimized PPC campaigns can cost you a $1 or $2 per click. Sometimes even more. So at the end of the day Hittail’s calculation is not that much off after all.

One very important part that Hittail users may miss is that by using Hittail suggestions it is much easier to maintain those coveted $0.10 per click campaigns. Hittail has helped me not only to increase natural search traffic. It also helped me to keep my PPC nice and clean with hundreds of keywords at $0.10 per click.

Am I saying you should abandon Google Analytics? Absolutely not! Hittail and Google Analytics can work with different data providing different analytics and you can benefit greatly from both.

According to some reports Foxtons a New Jersey based real estate firm may be filing for bankruptcy. Foxtons were well known in New York Metropolitan area for selling homes for as little as 2% commission, while traditional brokers ‘ fee in the same are is about 6%.

Young real estate agents where often attracted by the monthly salary as well as use of the company car and some other benefits offered by Foxtons. But no more. Foxtons announced to release 350 of their 380 employees.

When selling your home through a real estate agent, generally two agencies are involved in the transaction, the sellers broker and the buyers broker. The traditional fee is generally divided on 50/50 split basis.
